Great news today!

Today the SC Infrastructure Bank awarded Dorchester County $19M to address the following road improvements:

SC Highway 165 from Carolinian Drive (Legend Oaks) to Ashley Ridge High School - The road improvement will continue the 5 lane section from Bacon's Bridge Road Phase 1 project that will start this summer out to ARHS. HUGE Safety win for the community.

Old Orangeburg Road Intersection Improvements - Funds to improve intersections with traffic signals and turning lanes.

Right of Way (ROW) Acquisition funds for US 78 Phase 3 (Summerville to Jedburg)

Total awarded $19M. There has been a focused effort this year to find a solution to fixing the road to ARHS by the County and DD2 and it looks like we have one. With collaboration from DCTA, and support from the State Delegation we were able to secure these desperately needed and deserved funds.

One of your neighbors requested that the HOA share the following information with you in case any of you were interested.

SCE&G informed us that gas lines would be available to all streets in Legend Oaks, but there would be a cost associated with this install. The install is based on Rate or Return (ROR) for SCE&G, this means the expense can vary. There would not be any cost for SCE&G to connect an existing line to the exterior of homes. There is an existing line that was paid for by Harbor Homes when they built a home on Carolinian. Therefore, the surrounding owners had the opportunity to benefit from this. If individual owners are interested in gas options such as stoves, heaters, fireplaces and water heaters, they should contact SCE&G for more information. This would be an individual decision and would not be HOA related business.

Legend Oaks Santa's Workshop

Arrangements to have Santa come to Legend Oaks on Sunday, Dec. 4 from 3-5 PM.

We invite all the families in HOA 1 and 3 to join Santa and his helpers at the Legend Oaks Pavilion this Sunday.

Santa will be ready to hear your children’s requests for gifts and talk to them about their Christmas plans.

We will have crafts to take home and snacks.

Pictures are encouraged with not only Santa and the children, but with the entire family.

We will not provide on-site photos this year, but will help you take your own or email a photo taken by our elves.

It is that time again for an Annual Meeting. The Board and I are making preparations and will be notifying all owners once finalized. The purpose for conducting the Annual Meeting is to comply with the requirements of the Association’s By-Laws to conduct such meetings, for Board Member elections and for the Association Board to report on the status of the HOA for the year. There will be an election to fill one (1) Board Member position. The Board of Directors seats are staggered terms. Any interested persons can self nominate from the floor or submit a miniature biography explaining your knowledge and how it will be beneficial to the community. All bios must be submitted to Community Management Group no later than March 15^th, so that this information can be made available to the community. If you would like information regarding the nominees, please provide Community Management Group with your email address to be added to the distribution list.

The Architectural Review Committee is also looking for volunteers to fill a seat on the committee. The Architectural Review Committee reviews requests for any exterior modifications to homes in the community.

FW: Alert: Incident in Legend Oaks

Good Afternoon,

I was asked to send the following information regarding an incident in Legend Oaks. The following crime is a federal offense. If you see any suspicious activity, please report it to the Police and notify your Block Captain.

There was a situation this week in a section of Legend Oaks that may or may not have any connection to the "Diaper Requests" that some residents have gotten over the weekend (this took place in the main section of LO). Piles of mail were found stuffed in a bush along the walking path heading towards Beech Hill Elementary. The mail was clearly taken from a neighbor's mailbox on Marshside Drive within the last day or two; much of it was opened and rifled through. It appears someone was looking for money (birthday cards and such were opened). Perhaps a one-time instance, but it would not hurt to keep your eyes peeled in the community. Your Board Members and Community Manager has been notified. Please remember to check your mail daily to minimize any loss.

HOLIDAY SAFETY TIPS

The holidays are an exciting and busy time. With all of the joys of the holiday season come potential safety hazards. Help prevent accidents by following these tips:

Christmas tree safety begins with the selection and purchase of a fresh tree. When buying a live pre-cut tree, make sure the tree is still alive and healthy. A fresh tree is green, needles are hard to pull from the branches, and when bent between your fingers, needles do not break. Pull on the needles. The trunk should be sticky and the limbs should be very flexible. Lift the tree and bounce the cut end on the ground, if a bunch of needles come tumbling off, it isn’t a safe tree to take home.
When you get the tree home, cut off the bottom two inches of trunk to expose the fresh wood. This will create a fresh, raw cut for the tree to soak in water, allow for better water absorption and helps keep your tree from becoming a fire hazard.
Keep your tree well hydrated. Keep the water in the stand well above the fresh-cut bottom of the trunk.
Christmas trees dry out with heat, so place your tree away from heat sources such as fireplaces or heater vents.
When purchasing an artificial tree, look for the label “Fire Resistant”.
Unplug the lights and decorations when you are not home.
Check each set of tree lights for frayed wires, broken bulbs and loose connections.
Never run electrical cords under the carpets or rugs, over nails or in traffic areas.
Before using lights outdoors, check labels to be sure they have been certified for outdoor use. To hold lights in place, string them through hooks or insulated staples, not nails or tacks. Never pull or tug lights to remove them. Plug all outdoor electric decorations into circuits with ground fault circuit interrupters to avoid potential shocks.
In homes with small children, take special care to avoid decorations that are sharp or breakable, keep trimmings with small removable parts out of the reach of children to avoid the child swallowing or inhaling small pieces, and avoid trimmings that resemble candy or food that may tempt a young child to eat them.
Remember that mistletoe, holly berries and Christmas cactus are poisonous if swallowed.
Use care with “fire salts”, which produce colored flames when thrown on wood fires. They contain heavy metals that can cause intense gastrointestinal irritation and vomiting if eaten.
Do not burn wrapping papers in the fireplace. A flash fire may result as wrappings ignite suddenly and burn intensely.

Helpful Holiday Safety Tips

As the Thanksgiving and Christmas season approach, Law Enforcement Agencies would like to share the helpful hints below.

While Shopping or Going Out:
• Secure valuables out of sight in your trunk. BUT, Be aware that many cars now have fold-down seats or a remote trunk release inside the car. These conveniences make your trunk vulnerable to thieves willing to break a window.
• If at a mall or a shopping center, periodically go to the car and lock away purchases so they will not “disappear” when you put them down trying-on clothes or at the food court.
• Safeguard your purse, wallet, bank cards, and personal information. Identity thieves thrive in this environment.
• Keep close tabs on your children while shopping. With so many people it is easy for them to become lost. Make sure they know their full name, your full name, address, phone, and your cell or pager number to reach you if you get separated.
• Be aware of your surroundings going to your car, going into and out of your house, and while at the ATM.

At Home:
• Make sure to keep doors and windows locked.
• Turn on outside lights at night.
• Report persons or vehicles roaming your neighborhood, day or night so police may check them. They may be simply looking at Christmas lights, or they may be “casing” houses to burglarize.
• Place your tree where the gifts will be less visible from outside. Thieves like window-shopping through your windows.
• After Christmas, don’t put the empty boxes out on the curb. This makes it easy for burglars to decide which houses to burglarize (ie: new computers, TVs, electronics, video games…). Break down boxes and put them in the trash, making sure to save all paperwork. Also remember many electronic devices require original boxes for warranty repair.
• Immediately make an inventory listing the model and serial numbers of new items (and old ones if you haven’t already) and engrave personal markings on them

If Leaving Home (On a trip or just for a little while):
• Make it look like you are still there.
• Timers on exterior lights, interior lights, and TVs will help make it look like you are home. Don’t leave an answering machine message saying you are gone, in fact turning it off would be better.
• Double check all doors and windows, including second floor and basement. The doors should have dead-bolts; key locks for windows are also available.
• Have the neighbor pick up mail, papers, and ads, put out your trash can, and park in your driveway. Give them emergency and cell numbers to reach you.
• Call the police department to request a periodic residence check while you are away.

• When you return, look around outside first. If you see any evidence of a break-in, do not go inside. Go to a neighbor’s house and call police. The burglars could still be inside.

While traveling: THINK SAFETY
• Before you leave, inspect the car for safety (lights, belts and hoses, fluids, wipers, tires-both wear and air – DON’T FORGET TRAILER LIGHTS).
• Pack expensive items in the trunk, or under coverings to keep them out of sight.
• Pack safely. Items stacked in the back of a van, wagon, or SUV will become 60mph missiles in a crash! They also block the driver’s view. Items secured to the roof greatly alter the vehicle’s handling in wind and emergency maneuvers.
• When you stop, take the keys and lock the doors. This applies all of the time, at home and away. An unlocked, running car invites a thief.
• Use a CLUB or other device when parking for the night or at shopping centers Keep doors locked while driving. It adds strength in a collision.
• Use seat-belts and child restraints properly.
• Be careful with bank, gas, and credit cards.
• Take regular rest breaks.
• Never send your children into restrooms alone.
• Store money in separate places to minimize loss or theft.
• Stay on roads you know and take maps, cell phones, and chargers, as well as safety items like blankets, flashlights, jumper cables, a jack, and a good spare tire.
• Drive carefully- better than those around you. You need to get there alive!

Have a wonderful holiday season. Remember, most crimes and accidents are preventable. Officers are working hard to locate and stop crime, but everyone must do their part to lower their risk.

Tony Fowler discussed issues they have been having in HOA 1:

1. Younger children driving golf carts (some about age 11).

(The law states that a driver of a golf cart must be at least 16 and hold a valid driver’s license.)

2. The HOA has set up game cameras and photographed young people driving carts through

private yards

3. Vandals have been smashing pumpkins and doing other mischief with items out in the open in

yards.

4. Two men have been going door-to-door, offering to repair windshields. Solicitation is not

allowed in the area. One woman reported that she came out of a house she was visiting and

found the windshield of her van cracked. Shortly after, two men came through the

neighborhood looking for work repairing windshields. While this is the only report of a

cracked windshield, several residents in HOA I and HOA III have reported that the men

approached them, inquiring whether they needed glass repair.

5. A man approached Tony Fowler’s door to sell meals from East Bay Gourmet. The name East Bay Gourmet is on the side of the car. When asked to leave and told that solicitation is not allowed, he simply went on down the street, knocking on doors. Be aware that this may or may not be legitimate, and residents are asked to watch for this car. This could be an attempt to case houses.

Remember to call or email information about any questionable activity to Linda or Lt. Bense.

Lt. Bense mentioned again, the phone # 873-5111 for Dispatch, which will send a sheriff out.

Of course, they all emphasized, call 911 for any emergency.

If you need to call the police for some unlawful activity, please call your block captain when things settle down to let them know so that they can spread the word on any unlawful activities going on.

Police Log for the last two months, from the end of August to today, has been considerably less than in the past, and everyone feels that the diligence of all the members and families in our crime watch has brought this change about.

The following are reported incidents:

Sept. 4 - Theft from a motor vehicle

Oct 1 - Possible Burglary thwarted - Moving Van arrived, and a male tried the door handle of the

home. When confronted by home owner, the man left.

Oct 4 - Credit Card # Used - fraud

Oct 6 - Property damage (thought to be windshield)

Oct 10 - Larceny - items in plain view of street

Oct 15 - Credit Card Fraud

As you can see, things have improved. Please continue to be vigilant, close your garage doors during the day and at night, keep valuables out of cars, lock all outside vehicles, and keep outside lights on at night.

Halloween Safety Tips

*Make sure your Halloween costume isn't flammable. Check the tag to make sure it's okay. If you're not sure, don't buy or wear it. That includes any make-up, wigs or glue-on effects, such as scars, warts or fingernails.

*Don't go near open flames while you're wearing your costume, especially if it's got a lot of material to it. If you're wearing a long wig, try not to smoke while you're wearing it.

*If you plan to burn a candle in a carved pumpkin, do it outside on cement. Be sure to check it periodically. Extinguish the candle if you go to bed or leave the house.

*Carry a flashlight when you trick-or-treat.

Fall tips for Homeowners

Lawn health during the fall and winter months...

*I have found that along with using a fertilizer in the fall it is also a nice time to put down lime. Many landscapers use lime in January or February, but some have had the best results if applied in early November before we the ground gets too hard.

*I know it is much easier to just leave the leaves in your yard till spring, but that is not the best idea for your lawns health, so do your lawn a favor and remove the leaves.

*Please DO NOT burn leaves within the community or surrounding areas.

If you have not paid your assessment, a lien has been filed on your property. Keep in mind any legal fees incurred will be charged to your account. Please be advised the HOA will be pursuing foreclosures on delinquent accounts. It is not beneficial to you or your association to withhold assessments. A deficiency in collected assessments will result in a large bad debt for 2010, which in turn will effect 2011 assessments.

Incidents in Legend Oaks

The following information was reported to the Neighborhood Watch Group and we would like to share it with you and your neighbors.

Yesterday, Linda received an email from a neighbor, saying that she had seen three teenagers park a car in the cul-de-sac next to her home at 11 or 11:30 P.M. Monday night. They got out, jumped onto skateboards and sped down Carolinian Dr. Soon after, they returned, got back into their car and left. She didn’t get a license number, but she wondered if anyone had reported mischievous behavior on Monday night. Linda had no knowledge or reports of this.

Today a neighbor driving by said that her house was egged, as was her neighbor’s house. We are not sure of when these incidents happened, but they were reported to the Block Captain. Please notify your Block Captains when such things occur so that a general warning can be sent to all of our Captains and an informational email to Lt. Bense. The Neighborhood Watch can be effective only if everyone reports incidents—neighbors to Block Captains and sheriff (if needed), and Block Captains to Linda.

LEGEND OAKS HOA 3 NEIGHBORHOOD WATCH MEETING MINUTES

Wednesday, August 11, 2010

6:30 P.M.

Legend Oaks Club Pavilion

The meeting came to order at 6:30, and Lt. William Bense presented a report of sheriff’s business in our neighborhood for the time period of June 1 to August 10.

The good news is that the number of suspicious activities and calls to the Dorchester County Sheriff’s office is down considerably from earlier this year. Most of the calls reported automobile break-ins, and those were on unlocked vehicles. An arrest has been made, and the person responsible is currently in jail. More good news: While the national average of solving crimes is 11%, the average in Dorchester County is 26%-29%--That’s really impressive!

Lt. Bense reminds residents who will be away for any length of time that they can call the sheriff’s office to request a vacation watch of their homes. Some residents in attendance said that they have requested the patrol and have been very happy with the thorough check that officers have made of their property. Those who would like to request such service should call the Dorchester Sheriff’s non-emergency number, 843-873-5111. Please call only 24 hours prior to departure, not earlier.

With the beginning of the new school year upon us, several residents asked about having random speed checks, especially on Carolinian Drive and Veranda Drive. Lt. Bense will look into having the area patrolled between 7:00-8:00 A.M. and 3:15-3:45 P.M. A resident asked about the lack of a speed limit sign on Rt. 165, south of Rt. 61. The sign that had been posted is no longer there. Lt. Bense will contact SCDOT to see about having the sign replaced and possibly having the speed limit lowered from 55 mph to 45.

At the close of the meeting, Lt. Bense reminded everyone to continue to be cautious:

Keep an outside light on at night, lock house entrances, remove valuables from cars, lock the doors of cars parked in driveways, and close garage doors (even during the day). These simple precautions make a great difference in working toward a crime-free neighborhood.

As always, residents should report any suspicious activity to their Block Captains. Block Captains, please report the activity to Linda Berganske. Please remember, if you have an emergency, call 911; if there is a non-emergency, report it at 843-873-5111. In each case, please make a report to your Block Captain, too. Together, we can make—and are making—a positive difference in our community.

Many of you have concerns regarding your neighbors’ lack of maintenance of their homes and property, which may negatively affect your property. Please understand Community Management Group inspects the community once a week for covenants violations based on your community documents. Your Board of Directors sets standards based on these documents. Covenants enforcement actions are a form of legal action against an owner and cannot be discussed with concerned owners. I would like to assure you that we are doing everything we can to cite any homeowner that is not in compliance and we will continue to do so until the matter is resolved. Rezoning Request on Hwy. 61

Below is a message from an owner in Legend Oaks that the Board would like to share with all owners.

"I don’t want you to be surprised if a new business opens close to Beech Hill School. In case you missed the article in the Summerville Journal Scene and the small, difficult-to-read sign posted on Highway 61, there is a request before County Council to approve a zoning change for a five-acre property near Beech Hill School. An old automobile mechanic center is set to be rezoned to a “business” classification in order to become a new automotive mechanic center.

From the article in the July 23, 2010 newspaper article:

The location is about 100 yards away from Beech Hill Elementary School, towards the Highway 61 and Highway 165 intersection, and a black cloth draped on a chain-link fence is the only defining marker seen on the property at this time. There is also an abandoned metal building on the property.

The land is currently zoned for multi-family residential use, although it is surrounded by “business-type” uses, including a construction company and a county waste collection site. Robbie Robbins, attorney for the owner, said the owner bought it in 2008 and wants it to be an auto mechanic center or garage. The nearby properties were “grandfathered in” in order to operate businesses, and asked that the property also be considered for the zoning. “History (shows) as far back as the 1950’s, it’s been an automotive repair shop. …The assessor’s office (shows) that it operated this way in 2003 and 2007 with vehicles in the yard.”

The county’s zoning department did not recommend the rezoning, calling it “spot zoning.” Commission members said they have not gotten any feedback in favor of or opposed to the rezoning.

The planning commission unanimously recommended the rezoning, with a stipulation that the owner comply with all the required landscape buffers.

Residents who wish to provide feedback may contact Harold LeaMond, with the Planning and Zoning Department at 832-0020 (press 3 when prompted). The council is set to vote on the issue at their regular meeting on Aug. 16 at 7 PM in St. George, 201 Johnston St.

Please drive by the property and consider this rezoning request. The property is sandwiched between other businesses and would not be a suitable location for multi-family residential development in my opinion, as it is currently zoned. But the additional traffic and noise may impact both homes and the school. If you are concerned, please notify Mr. LeaMond or plan to attend the council meeting on the 16th."

It has been brought to our attention that the ponds and drainage systems have been used as a dumpsite for discarded fish in a specific area of the community. The drainage systems are in place for a reason and must not be altered in anyway. The most recent incident has caused a blockage and the County has been notified. Due to the extreme hot weather, we have been experiencing algae outbreaks in many community ponds. Please understand we are working diligently with the lake management company to rectify or prevent any issues. Ponds are chemically treated on a monthly basis however, the extreme weather changes in recent months have taken its toll on the ecosystems in these ponds. Late spring and early summer are the most difficult times to maintain consistency in the ponds. By late summer, the ecosystems should be balanced but cannot be guaranteed.

District Director of Crime Watch, Susan Gillespie, and Lt. Bense of Dorchester Sheriff’s Department have agreed to meet with our Neighborhood Watch Group on March 10, 6:00 PM at the Legend Oaks Golf Club. This is not a HOA meeting. This will be our first Neighborhood Watch meeting, for group members only. If you know of anyone else that wants to join the group, please have them contact Debbie Davis.

Ms. Gillespie & Lt. Bense will still attend the meeting of the 24^th, but this meeting is for our group, only.

Tips For Winter Preperation

Chilly fall temperatures serve as a polite reminder that when winter arrives it can be sudden, often leaving homeowners unprepared for the troubles associated with extreme cold. A few simple preparations now will help prevent headaches and costly repairs throughout the winter months.

•Disconnect outside water hoses. If left connected, water in the hoses can freeze and expand causing faucets and connecting pipes inside your home to freeze and break.

•Make sure outside faucets aren't dripping or leaking. Make the necessary repairs or call a plumber before freezing temperatures arrive. Be aware that when pipes freeze, water pressure builds causing cracks - no matter if the pipe is made of plastic, copper or steel. Even a tiny crack can unleash more than 250 gallons of water in a single day

•If your home is equipped with interior shut-off valves leading to outside faucets, close them and drain water from lines.

•Cover outside faucets using a faucet insulation kit available at home centers.

•Insulate pipes in unheated areas, such as garages or crawl spaces. Apply heat tape or thermostat-controlled heat cables around pipes that are exposed and prone to freezing.

•Seal leaks around doors and windows to reduce cold air penetration.

•Your water heater works harder during winter months. Flush it out and remove sediment buildup, which causes corrosion, shortens life span and reduces heating efficiency. Drain several gallons from the faucet near the bottom of the tank. Connect a hose to the faucet and direct water into a nearby drain.

•Carefully test the water heater's pressure relief valve (Danger: water is very hot) by lifting up on the lever and letting it snap back. The valve should allow a burst of hot water into the drainpipe. If not, call a professional to have a new valve installed.

•Check the temperature setting on your water heater's thermostat. Set at 120°F for optimum performance.

•Clear leaves and debris from outside downspouts to ensure easy drainage when water freezes and thaws throughout the winter season.

•Inspect and clean sump pump and pit. Pumps exposed to extreme cold can freeze, preventing the pump from operating.

•When leaving home for extended periods, shut off the main water valve and drain the system by opening faucets at the highest and lowest points of the house. Make sure the heat is left on and set no lower than 55°F.

Caution! These tips are intended for homes that will be inhabited throughout the winter months. Many additional steps should be taken to winterize vacation properties that will be abandoned or left unattended for weeks or months at a time. Seek professional help for winterizing such properties.

Halloween Safety Tips

*Please DO NOT burn leaves within the community or surrounding areas.

*Make sure your Halloween costume isn't flammable. Check the tag to make sure it's okay. If you're not sure, don't buy or wear it. That includes any make-up, wigs or glue-on effects, such as scars, warts or fingernails.

*Don't go near open flames while you're wearing your costume, especially if it's got a lot of material to it. If you're wearing a long wig, try not to smoke while you're wearing it.

*If you plan to burn a candle in a carved pumpkin, do it outside on cement. Be sure to check it periodically. Extinguish the candle if you go to bed or leave the house.

*Carry a flashlight when you trick-or-treat.

US Airforce low-level fly-over

I would like to pass on some information that was given to Community Management Group. This afternoon Friday, October 2, 2009 at 3:50 p.m., the United States Air Force will perform a low-level fly-over of the Citadel Parade Grounds. A C-17 and a B-25 will fly at low levels over James Island, West Ashley and peninsula Charleston. Citizens should not be concerned about this event. This information was provided to the Charleston Police Department by the USAF Public Affairs Office.

Alligators

The Department of Natural Resources no longer is involved in alligators except to issue permits to HOA's. There is not a “move” or “relocate” policy. They simply authorize the HOA to have them destroyed. Your HOA would then hire a licensed company who does that as quietly as possible…We have an informative article on our website that we ask owners to read, as well as this FAQ.

Alligators are only a hazard to people and pets when they lose their natural fear of humans by being fed, often by workmen and kids. Alligators LOVE marshmallows, food wrappers and lunch scraps. A licensed “trapper” that the Association uses will approach the animal to determine from much experience whether it exhibits signs of aggression or otherwise accustomed to humans and may pose a threat. There are perhaps thousands in the area and they do move around, primarily over ground, though there is a frequent (and incorrect) assumption that they move through storm culverts. On the contrary, they do not often enter them because they cannot turn around nor move well backwards.We have seen that shortly after removal another animal will move into a vacant pond. They were here for millions of years before people and most locals have a certain sentiment for them… When owners call with similar encounters or concerns we ask that they carefully consider whether this animal was really stalking a pet (or whatever the concern) and represents an unusual threat for being acclimated to humans as a source of food, or was just “walking around” or sunning before they call for its head. If you feel that a particular animal is a threat worthy of destruction, please let us know and we’ll elevate the request for removal to the Association Board. There are currently alligators that migrate from pond to pond in your community, so always be aware of your surroundings. Remember if you ever see anyone harassing an alligator please call the local authorities.

I would like to let everyone know that exterior modification requests will not be reviewed by the ARC for any property in arrears. If you have not paid your assessment please do so. The Board is looking to move forward with extreme collection procedures to collect unpaid assessments.
